Catering Terms & Conditions
These Terms & Conditions outline the agreement between Happy Plate and the client, including booking requirements, responsibilities, cancellations and service provisions.
1. Definitions
‘Happy Plate’ means Happy Plate. ‘the Client’ means the person, firm or company making the Booking, and ‘the Booking’ means the function specified in the quotation in regards to which Happy Plateis providing certain goods and/or services; ‘The Quotation’ means Happy Plate aggregate quotation of price for each element of the Booking as set out in the quote provided to the client, based on the estimated number of persons who will be attending the Booking; ‘Terms and Conditions’ means the standard terms and conditions set out in this document and includes any special terms and conditions agreed in writing between the client and Happy Plate.
2. Quotations
Quotations are valid for a period of 30 days from the date the Quotation is given to the client, unless withdrawn by written notice by Happy Plate to the Client's acceptance of it in writing.
3. Booking Confirmation
No Booking shall be deemed accepted by Happy Plate unless and until confirmed in writing by the Client. The Clients signature will confirm acceptance of both the Quotation and of these Terms and Conditions.
4. Third Party Arrangements
When a function is arranged on behalf of the Client by a third party, written acceptance from the Client of the Quotation (including agreement to pay the deposit and final invoice) must be provided to Happy Plate.
5. Guest Numbers & Dietary Requirements
All prices quoted are for a specific number of guests, and any change in numbers or dietary requirements will affect the overall price contained in the Quotation (which may be amended from time to time by Happy Plate to reflect any such changes.)
Confirmation of final minimum numbers and dietary requirements must be given at least 5 working days prior to the date of the event.
If the number, or dietary requirements, of the persons who attend is more than the number notified, or changed (as appropriate), the Client will be charged for each such additional guest.
6. Variations
The price or contents of the menus, decorations or any other elements of the booking that Happy Plate shall supply are subject to market availability and consumption on the event.
Any alteration in price, content or quantity of a specific element will be noted to the client.
Happy Plate accepts no responsibility for beverages supplied by the client or beverages left at the venue.
7. Deposits
A Deposit of 50% of the Quotation is payable by the Client not later than 7 days before the date of the Booking and the deposit serves as booking confirmation to the client once it has been received, or by such earlier date as may be specified in the Quotation.
If the Client fails to pay the deposit on or before the date requested, Happy Plate shall be entitled to cancel the booking and charge the client in accordance with clause 9.

10. Cancellation
If a Booking is, or a specified number of the Clients’ guests at Booking are cancelled after it has been confirmed by the Client, the Client will be liable for any loss, costs (including the costs of all labour and materials used), damages, charges and expenses incurred by Happy Plate as a result of cancellation.
Happy Plate may at its option assess those costs on the basis of schedule 1.
If the event is cancelled by the client up to 7 days prior to the event, the deposit will not be refunded.
Full payment will be owed by the client if the event is cancelled within 7 days of the event.
11. Food
Happy Plate cannot be held responsible for the safety of any food supplied directly by the Client.

The Quotation for Staff is based on the projected time for which the staff will be required (minimum hours – 4)
Where the event extends beyond this time, an additional charge will be made pro rata.
The cost of staff transport for staff expected to leave after 23:00pm will be charged to the client.
14. Equipment & Claims
Happy Plate is wholly responsible for all equipment supplied by Happy Plate for the purposes of the Booking from the time of delivery to the Client or the Booking until it is collected.
Any claim alleging any default in the performance of any of Happy Plate’s obligations under these Terms and Conditions must be brought to the attention of the managing director of Happy Plate in writing no later than 14 days from the date of completion of the Booking.
The insurance covering Happy Plate also covers the rental equipment.
15. Client Responsibilities
The Client will indemnify, defend and hold harmless Happy Plate its partners, principals, offices, directors, agents and employees from and against any and all demands, claims, damages to persons or property, losses and liabilities, including reasonable legal fees, arising out of or caused by the clients negligence or wilful misconduct in connection with the Booking.
16. Force Majeure
Neither party shall be liable to the other for any delay or non-performance of its obligations under these Terms & Conditions arising from any cause beyond its reasonable control including, without limitation, any of the following; act of God, Governmental act, war, fire, flood, explosion or civil commotion.

Happy Plate shall not use, copy, adapt, disclose or part with possession of any business, employee, customer or guest information or data of or relating to the Client which is disclosed directly as a result of these Terms & Conditions except as strictly necessary to perform its obligations or exercise its rights under these Terms & Conditions or with written consent of the Client.

22. Entire Agreement
These Terms & Conditions and any documents referred to herein, set out the entire agreement and understanding between the parties and supersede all previous agreements between the parties relating to the subject matter hereof.
23. Detailed Cancellation Schedule
Schedule 1: Cancellation
In the event of the cancellation of a Booking, pursuant to clause 9 above, the following percentage of the sales value will be charged to the Client:
Food
Cancellation 7 days or more prior to the event– 50% of quoted cost
Cancellation within 7 days – 100% of quoted cost
Hired Equipment
Cancellation within 14 days – 25% of quoted cost
Cancellation within 7 days – 50% of quoted cost
Cancellation within 2 days – 100% of quoted cost
Marquee
Cancellation within 14 days – 100% of quoted cost or subject to terms agreed with individual marquee suppliers.
Staff
Cancellation within 7 days – 50% of quoted cost
Cancellation within 72 hours - 100% of quoted cost
Flowers
Cancellation within 7 Days – 50% of quoted cost
Cancellation within 48 hours – 100% of quoted cost
Decorations
Cancellation within 21 days – 50% of quoted cost
Cancellation within 7 days – 100% of quoted cost
Entertainment
Cancellation within 7 days – 100% of quoted cost or as specified by artistes
Lighting
Cancellation within 1 Calendar month – 50% of quoted cost
Cancellation within 7 days or once work has started on site – 100% of quoted cost
Locations
Cancellation within 14 days – 100% of quoted cost or subject to terms agreed with individual locations
Wines, Spirits and Beers specially purchased
Cancellation within 14 days – 50% of quoted cost.
Cancellation within 7 days – 100% of quoted cost.
